Welcome to BrightFeed. These Terms of Service ("Terms") govern your use of the BrightFeed website and application (the "Service") operated by BrightFeed ("we," "our," or "us").
By accessing or using BrightFeed, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility
You must be at least 13 years old to use BrightFeed. By using the Service, you represent that:

- You have the legal capacity to enter into these Terms
- You are not prohibited from using the Service under applicable law
2. Account Registration
To use BrightFeed, you must create an account. You are responsible for all activity that occurs under your account. If you believe someone has gained unauthorized access to your account, please notify us immediately.
3. The Service
3.1 Description
BrightFeed is an attention management service. People face more content than they can process, and the items they need now are buried under things that distract or can wait. BrightFeed helps you own your attention by analyzing and filtering email, web, video, and beyond to surface what matters when you need it.
3.2 Third-Party Accounts
When you connect third-party accounts (like Gmail), you authorize us to access content from those accounts as described in our Privacy Policy. You represent that:
- You have the right to grant us access to those accounts
- Your use complies with the third party's terms of service
- You will not connect accounts that you do not own or control
3.3 AI Analysis
BrightFeed uses artificial intelligence to analyze your content. You understand that:
- AI analysis may not always be accurate
- Content is sent to third-party AI providers for processing
- AI providers do not retain your content after processing
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Infringe the rights of others
- Access accounts or data that you do not own or have permission to access
- Interfere with or disrupt the Service or its infrastructure
- Attempt to gain unauthorized access to our systems
- Use automated means to access the Service (except through our official API, if provided)
- Reverse engineer, decompile, or disassemble the Service
- Resell or redistribute the Service without permission
5. Intellectual Property
5.1 Our Rights
BrightFeed and its original content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. Our trademarks may not be used without prior written consent.
5.2 Your Content
You retain ownership of content you connect to BrightFeed. By using the Service, you grant us a limited license to access, store, process, and display your content solely to provide the Service to you.
5.3 Feedback
If you provide feedback or suggestions about the Service, you grant us the right to use that feedback without compensation or attribution.
6. Fees and Payment
BrightFeed may offer free and paid subscription plans. If you subscribe to a paid plan:
- You agree to pay all applicable fees
- Fees are billed in advance on a recurring basis
- You can cancel at any time; cancellation takes effect at the end of the billing period
- Refunds are provided at our discretion
7. Disclaimers
7.1 "As Is" Service
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7.2 No Guarantee
We do not guarantee that:
- The Service will be uninterrupted, secure, or error-free
- Results from the Service will be accurate or reliable
- The quality of the Service will meet your expectations
- Any errors will be corrected
7.3 Third-Party Content
Content accessed through connected accounts originates from third parties. We are not responsible for the accuracy, legality, or appropriateness of that content.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIGHTFEED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the Service
- Any unauthorized access to or alteration of your data
- Any third-party conduct on the Service
- Any other matter relating to the Service
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE SIX MONTHS PRIOR TO THE CLAIM.
9. Indemnification
You agree to indemnify and hold harmless BrightFeed and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another
10. Termination
10.1 By You
You may terminate your account at any time by deleting it in your Profile settings or by contacting us. Upon termination, your data will be deleted as described in our Privacy Policy.
10.2 By Us
We may suspend or terminate your account at any time, with or without cause, with or without notice. Reasons for termination may include:
- Violation of these Terms
- Conduct that we believe is harmful to other users or the Service
- Extended periods of inactivity
- Discontinuation of the Service
10.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and indemnification.
11. Dispute Resolution
11.1 Governing Law
These Terms are governed by the laws of the State of Oregon, United States, without regard to conflict of law principles.
11.2 Informal Resolution
Before filing a formal dispute, you agree to try to resolve the dispute informally by contacting us. We will try to resolve the dispute within 30 days.
11.3 Arbitration
If we cannot resolve the dispute informally, you agree that any dispute will be resolved by binding arbitration, rather than in court, except that either party may bring claims in small claims court. The arbitration will be conducted by JAMS under its rules.
11.4 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Posting the new Terms on this page with an updated date
- Sending an email notification for significant changes
Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.
13. General Provisions
13.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BrightFeed regarding the Service.
13.2 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
13.3 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
13.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
